Terms of Service
The agreement between you and Viamione for using the ERP, website and customer portal.
Last updated: 19 October 2026
1. About these terms
These Terms of Service ("Terms") are a contract between you and Viamione ("Viamione", "we", "us") for the Viamione ERP software-as-a-service, the website and the customer portal (together, the "Service"). By registering, paying for or using the Service you accept these Terms. This is an electronic record under the Information Technology Act, 2000 and needs no physical or digital signature.
If you accept the Terms for a company or other organisation, you confirm you are authorised to bind it, and "you" means that organisation.
2. Eligibility
You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872. The Service is intended for business use; you may not use it to run a business that is illegal in India.
3. Your account and installation
You register with a verified email address. You are responsible for the accuracy of what you give us (including company name, address, and GSTIN if you have one) and for keeping credentials confidential. Everything done with your credentials is treated as done by you. Tell us at once if you suspect misuse.
Each paid plan gives you a separate installation (your own workspace and database). After your payment is confirmed, we provision the installation and email the administrator's sign-in details. You should change the generated password at first sign-in.
4. Plans, prices and payment
Prices are shown in Indian rupees and are exclusive of GST unless stated otherwise. GST is added at the applicable rate; the place of supply (and so the CGST + SGST or IGST split) follows the state of your GSTIN, or the state you select if you are not GST-registered.
Before you pay, we issue a proforma (payment request). It is not a tax invoice and is valid for 7 days. When your payment is received we issue a GST tax invoice and activate your installation. If the proforma lapses, the draft installation is cancelled and its name is released; you may start again.
Subscriptions renew for the billing period you chose (monthly or yearly). Renewal invoices are raised before the period ends and are payable by the due date. We may suspend an installation for non-payment after notice. Payments are processed by Razorpay; we do not see or store your card or bank credentials.
You must pay in good faith and may not charge back a payment for a service that was delivered.
5. Cancellation and refunds
You may stop using the Service at any time; cancel from your customer portal or write to us. A cancellation takes effect at the end of the paid period, and fees already paid for a started period are not refundable, except as set out below.
We refund in full where: (a) you were charged but the installation could not be provisioned and we cannot fix it within a reasonable time; (b) the same payment was taken twice; or (c) a payment was received but could not be applied to your account. Approved refunds go back to the original payment method, normally within 7 working days of approval. Where required by law, a credit note is issued against the tax invoice.
6. Your data
Your business data in your installation is yours. You give us the limited right to host, back up, process and display it to provide the Service. We act on your instructions as a data processor for personal data of your customers, staff and suppliers that you put in the Service; you are responsible for having a lawful basis and any needed consents for that data. See our Privacy Policy.
You can ask our support team for an export of your data while your installation is active and for 30 days after it ends; we will provide it in a common format within a reasonable time. After that we may delete it, subject to any retention the law requires.
7. Acceptable use
You agree not to:
- break any law, or use the Service to store or send unlawful, infringing, defamatory or malicious content
- attempt to access another customer's installation, probe or test the security of the Service without our written permission, or overload it
- reverse engineer, resell or white-label the Service without a written agreement
- send spam or unsolicited commercial messages using the Service, or breach the rules of the telecom and email providers we use
- share credentials across unrelated businesses or exceed the user, branch or usage limits of your plan
8. Statutory responsibility for your accounts and taxes
The Service helps you prepare invoices, e-invoices, returns and books. You remain responsible for the accuracy of your entries, your tax and statutory filings, e-invoicing and e-way bill compliance, and for checking outputs before filing. We are not your tax adviser.
9. Availability and support
We work to keep the Service available and take regular backups, but we do not promise uninterrupted or error-free operation. We may carry out maintenance, and will try to give notice of planned downtime. Support is provided by email on business days.
10. Intellectual property
We and our licensors own the Service, its software and branding. You get a non-exclusive, non-transferable right to use it during your subscription. Feedback you give us may be used without obligation.
11. Suspension and termination
We may suspend or end your access if you materially breach these Terms, do not pay after notice, or if needed to meet a legal order or protect the Service. Where practical we will warn you first. Sections that by nature survive termination will survive.
12. Warranty disclaimer and limit of liability
The Service is provided "as is" to the extent permitted by law. We are not liable for indirect or consequential loss, loss of profit, revenue or goodwill. Our total liability for any claim is limited to the fees you paid in the 12 months before the claim arose. Nothing here limits liability that cannot be limited by law.
13. Indemnity
You will indemnify us against third-party claims arising from your content or your breach of these Terms or the law, to the extent permitted by law.
14. Changes
We may update these Terms. For material changes we will give notice by email or in the Service. Continued use after the effective date means you accept the update. The date at the top shows the latest version.
15. Governing law and disputes
These Terms are governed by the laws of India. We will try to settle any dispute by discussion first. A dispute not resolved within 30 days will be referred to a sole arbitrator appointed under the Arbitration and Conciliation Act, 1996, seated in India, in English. Subject to that, the courts at the place of our registered office in India have exclusive jurisdiction.
16. Grievance and contact
In line with the Information Technology (Intermediary Guidelines) Rules, 2021 and the Consumer Protection (E-Commerce) Rules, 2020, our Grievance Officer is Grievance Officer, at support@viamione.com. We acknowledge complaints within 48 hours and aim to resolve them within one month.
General support: support@viamione.com.
